What is earnest money in Texas?

What the deposit signals, where it goes, how it differs from the option fee, and why delivery deadlines and refund rights come from the signed contract.

Earnest money is a buyer deposit delivered to the escrow agent under a real-estate purchase contract. It shows contractual performance and is generally credited within the transaction at closing, but it is not automatically refundable or automatically forfeited. The signed contract, addenda, notices, deadlines, and facts determine how the funds are handled.

Read paragraph 5, not a rule of thumb

The current TREC One to Four Family Residential Contract (Resale), Form 20-19, became effective July 1, 2026. Paragraph 5 identifies the earnest-money amount, option-fee amount, escrow agent, delivery location, deadline, and any additional earnest money. Other contract forms and custom contracts can differ.

Under Form 20-19, the buyer generally must deliver the stated earnest money and option fee within three days after the effective date. If the last delivery day falls on a Saturday, Sunday, or legal holiday as defined by the form, the deadline extends to the end of the next day that is not one of those days. Time is expressly stated to be of the essence.

Earnest money and option fee are different

Earnest money is a contract deposit held by the escrow agent and applied within the transaction if the sale closes. The option fee is consideration for the buyer's unrestricted termination right during the negotiated option period when the contract requirements are satisfied. Under the current form, the option fee is credited to the sales price at closing.

If the buyer timely terminates under the option paragraph, the form says the option fee is not refunded and the earnest money is refunded. That example does not mean every termination produces the same result. Financing, appraisal, title, property-condition, default, and other provisions have their own language and deadlines.

Refunds depend on contract rights and performance

Whether earnest money is released can depend on the termination ground, notice delivery, deadline compliance, contractual cure rights, amendment terms, and the parties' instructions to the escrow agent. A lender's denial or a low appraisal does not create a universal refund rule without reference to the financing and appraisal provisions actually included in the contract.

An escrow agent may need written authorization, a release, or another legally sufficient basis before disbursing disputed funds. The mortgage lender does not decide the parties' contract rights. Questions about a disputed deposit or notice should go to the parties' real-estate professionals or legal counsel.

How it appears in mortgage closing figures

When the transaction closes, earnest money already deposited is generally reflected as an amount paid by or on behalf of the buyer in the settlement figures. It reduces the remaining cash the buyer must bring, but it is not a lender credit, seller concession, or reduction of the minimum required investment by itself.

Compare the executed contract and receipts with the Closing Disclosure. If the amount is missing or wrong, raise it with the settlement agent before sending final funds.

How much earnest money is required in Texas?

There is no single universal amount for every Texas residential purchase. The amount is negotiated and written into the applicable contract. Market custom, transaction risk, property, and offer strategy can influence it.

When is earnest money due under the current TREC resale contract?

TREC Form 20-19 generally requires delivery within three days after the effective date. Its legal-holiday provision can extend a deadline that falls on a Saturday, Sunday, or defined legal holiday. Other forms can differ.

Is earnest money the same as the option fee?

Does earnest money reduce cash to close?

When properly credited in a closing transaction, earnest money already paid generally reduces the remaining amount the buyer brings. Confirm the deposit appears correctly in the final settlement figures and Closing Disclosure.
